In other words, the product name constitutes an "implied promise" about the drink's ingredients, which Starbucks violated New York's rules against fraud and false advertising.

The lawsuit argues that the presence of fruits is "central" to the identity of the products and that consumers have reason to expect Starbucks cold drinks to contain all of the fruits listed in their respective names. In fact, Starbucks hot chocolate contains cocoa, matcha latte contains milk tea, honey mint tea contains honey and mint, these also meet consumer expectations.
However, an 18-page case claims that cold drinks on Starbucks menus such as Mango Dragonfruit and Mango Dragonfruit Lemonade Refresher do not contain mango, Pineapple Passion Fruit and Pineapple Passion Fruit Lemonade Refresher do not contain passion fruit, and Strawberry Acai and Strawberry Acai Lemonade Refresher do not contain acai.

Fruit cold drinks do contain ingredients such as freeze-dried strawberries, freeze-dried pineapples, and freeze-dried pitaya. However, the lawsuit argues that the apparent lack of juice in these cold drinks is important to consumers because they contain far more nutrients than concentrated grape juice, such as mango, passion fruit and acai berries.
Robert Abili, the Los Angeles attorney who filed the lawsuit, did not immediately respond to a request for comment, and the Queens woman in the incident did not specify the amount of potential damage, but said the "amount in dispute" exceeded $5 million.
A Starbucks spokeswoman said Starbucks headquarters had not received the lawsuit and had no comment.
