Today, a tweet saying "Blogger is setting up a stall in a scenic spot to resell lemon water from Mixue Ice City" attracted public attention and discussion.
"Jingshi Live" reported that a blogger discovered a business opportunity and ordered dozens of cups of Mixue Ice City lemonade at one time through takeout, used takeout incubators and ice bottles to store them, and transported the lemonade to crowded places and sold them to passers-by. The blogger said that he increased the price of lemonade from the original price of 4 yuan (cost 3.4 yuan) to 6 yuan, and sold a total of 98 cups (including 2 cups self-drinking) in 3 and a half hours, making a final profit of 254 yuan.
After the relevant video was posted online, it quickly attracted the attention and heated discussion of the onlookers. Some people praised the blogger for his ingenious thinking and being a "commercial genius," saying that the price of mineral water in the scenic area is generally high. In contrast, lemonade with a price increase of 6 yuan is still acceptable to consumers.
However, some people question the illegal risk of secondary sales after group purchase, and believe that if the brand party pursues it, the resellers may face legal liability. Moreover, if there are food safety problems in the drinks sold to passers-by and cause physical discomfort to the drinker, should the responsibility be attributed to the brand or the seller?
In addition to the above, some fans of Mixue Ice City said that in Henan, Sichuan and other cities, employees of Mixue Ice City can actually be seen driving electric vehicles to sell prepared drinks in parks, schools, doorways and other places where people gather.
Citizens who have seen these trolleys introduced that shop assistants put drinks made by stores on cars and sell them along the street. When passers-by hears the familiar jingle coming from the stereo, they may stop to buy a cup. According to them, the brand allows stores to increase revenue in this way. However, when employees sell them outside, the drink price of the trolleys is consistent with the store price, and there will be no price increase.
Therefore, some people also question whether it was the personal behavior of certain store employees by bloggers who sold lemonade at Mixue Ice City after increasing the price.
As related topics hit the hot searches, the reporter called Mixue Ice City customer service about this matter. The staff said that the relevant situation had been recorded and would be fed back to the relevant departments of the company, and a dedicated person would subsequently verify whether the employee went out of the store for sale or was resold by others.
As for whether this kind of secondary sales is illegal, some lawyers told reporters that from the perspective of legality, the products sold by the resellers are purchased through formal channels, and they are not counterfeit, bid up prices, or infringe on the rights and interests of others, which generally does not constitute an offence. However, resellers may violate local regulations on mobile vendors due to lack of business licenses and failure to apply for relevant certificates.

In addition, the lawyer pointed out that after Mixue Ice City sells the product, the buyer has the right to dispose of it, and the brand has no right to restrict its resale behavior. If the brand limits the resale price, it may be suspected of violating the provisions of the Anti-Monopoly Law on vertical monopoly agreements.
As for the resellers 'behavior of setting up stalls and using the "Mixue Ice City" sign and logo, lawyers said that their subjective purpose is mostly to indicate the source of the product and not to maliciously infringe trademark rights. If they do not have a negative impact on the brand and the logo is used reasonably, it usually does not constitute infringement.
