Blue Mountain Flavor Charcoal Coffee Detected Mold Exceeds Standard and Forced to Pay Fine
On November 25, 2013, Haikou Food and Drug Administration conducted a spot check on the "Jinpan Yanshi" Lanshan flavor charcoal-roasted coffee produced by Yan's Coffee Company on November 05, 2013.11. After inspection, it was found that the mold index in this batch of coffee exceeded the standard by 3 times, and the test conclusion was unqualified products.
On June 11, 2014, the food and drug inspection detachment of Haikou City issued an administrative penalty decision on Yan's Coffee Company according to the test results, imposed a fine of 10880 yuan twice the value of the goods on the company, totaling 21760 yuan, and confiscated 1280 yuan of illegal gains. It is required to pay the fine and forfeiture within 15 days from the date of receiving the penalty decision. However, Yan's Coffee Company failed to comply with the penalty decision. On June 27, 2014, Haikou Food and Drug Inspection Detachment imposed an additional fine of 3% of the amount of the administrative penalty decision, totaling 44467.2 yuan.
Yan's Coffee Company refused to sign a reminder for administrative punishment and refused to accept the administrative punishment made by the food and drug inspection detachment of Haikou City. In August 2014, Yan Coffee Company filed an administrative lawsuit with Haikou Xiuying District people's Court. According to the investigation by the Xiuying District people's Court, 3200 boxes of blue mountain flavor charcoal-roasted coffee produced by Yan's Coffee Company, which exceeded the standard by 3 times the mold index, have been sold out, and the punishment imposed by the food and drug inspection detachment of Haikou City is in line with the provisions of the law, rejecting the lawsuit request of Hainan Yan Coffee Company. Yan's Coffee Company refused to pay the fine was enforced.
As for the verdict of the Xiuying District people's Court, Yan Coffee Company was still not satisfied, so it appealed to the Haikou Intermediate people's Court. On January 21, 2015, the Haikou Intermediate people's Court issued an administrative judgment rejecting Yan's appeal and upholding the original judgment.
Yan's Coffee Company still refused to comply with the administrative penalty decision after the court issued the judgment of the second instance. In May 2015, the Haikou Food and Drug Inspection Detachment submitted an application to the Xiuying District people's Court in accordance with the law, demanding that Yan's Coffee Company be imposed an administrative penalty of 21760 yuan, confiscated 1280 yuan of illegal income, and pay a late fee of 21427.2 yuan.
The reporter learned that after the food and drug inspection detachment of Haikou City and the staff of the people's Court of Xiuying District did their work many times, the representative of Yan's Coffee Company expressed his willingness to implement the decision of administrative penalty on November 10 and December 2 this year respectively. He paid a total of 44467.2 yuan in fines and forfeiture in two installments.
