"Red label rose summer""rose summer coffee" became a private trademark?!
It is believed that coffee lovers are no stranger to the general names of these coffees such as "Red Standard Rose Summer" and "Rose Summer Coffee". However, recently, through the inquiry on the website of the State Trademark Office, it is known that some merchants are registering these common names as their own product trademarks, and some trademarks have passed the examination and approval of the Trademark Office.

Rosa coffee beans come from the Kafa forest of Mount Rosa in Ethiopia. In 1931, an Englishman collected coffee beans in the forests of Mount Rosa in southwestern Ethiopia and exported them to Kenya in 1932. It was introduced to Uganda and Tanzania in 1936 and Costa Rica in 1953, while Panama was introduced from CATIE in Costa Rica by Mr. Francis Coselazin of Dongba Seven Farm in the 1970s and distributed to other coffee plantations. Rose Summer Coffee can not become famous without Daniel, the owner of the Emerald Manor. We have heard the most about rosy summer coffee varieties in the past. "in 2003, Daniel, the owner of the Emerald Manor in Panama, vaguely smelled a charming fragrance of flowers in a pile of processed coffee beans. So I found this batch of coffee beans from the windbreak."

Daniel, owner of the Jade Manor, shared at the GRAND CRU event
In response to such rumors, Feicui Manor owner Daniel shared his rosy summer discovery history at the event of Grand Cru, a well-known coffee producer, and said the idea of "windbreak forest" was groundless. Daniel said that it was only after years of comparison and testing that he finally locked in the "Rose Summer Variety" in 2003. Two weeks before the 2003 BOP competition, when selecting the participating batches on the internal cup test table, it was found that the rose summer variety had outstanding flavors such as jasmine, citrus, peach, blueberry, bergamot and sugar cane, which were different from those of the coffee circle at that time, but Daniel still chose to compete with the rose summer variety and won the first place in the competition.
The winning variety of Jadeite Manor was originally marked as Geisha, but it was translated as Gesha after it was introduced in Japan. In Japanese, the pronunciation of Gesha is similar to that of Japanese, but it is expressed in Chinese characters and translated into geisha in Chinese. Later, after the introduction of Taiwan, the local coffee industry used the "geisha" to name the Rosa variety. On the other hand, it was around 2006 in mainland China. Mr. Yuan, the Chinese head of Curou Meng Coffee, introduced Rose Summer to the mainland in Panama and named the variety "Rose Summer" by means of direct transliteration. For more than a decade, the words "geisha coffee", "rose summer coffee" and "rose summer coffee" have also become common Chinese names to describe Geisha varieties and coffee beans. After the Feicui Manor became famous through the rose summer varieties in 2004, it also graded the rose summer varieties produced in the manor. Before the 2021 production season, the Jade Manor divides the rose varieties into three grades, and uses red, green and blue as the label background color to distinguish. In China, because we want consumers to remember each level more clearly, we use the abbreviations of red mark, green mark and blue mark to distinguish grades. On the other hand, "Red Standard Rose Summer", "Green Standard Rose Summer" and "Blue Standard Rose Summer" have also become a general name representing the variety grade of Jadeite Manor.

From the beginning of the 2021 season, Rose Summer, which is planted at 1500 meters (the original blue label), has been sold in bulk to a raw bean company, which has launched a brand called "Las Rocas", which is translated into Chinese as "volcanic Rose Summer". The corresponding label color of "Esmeralda Special Jadeite Special selection" is red, that is, the red mark Rose Summer. The jadeite special series is the highest quality rose summer coffee beans sold by the jadeite manor. it grows in a detailed plot of 1600-1800 meters above sea level, and the cup test of each batch must be more than 90 points. Usually this series comes from two sub-estates, Haramillo and Cannes Vidis (the Veil Manor has also produced a series of red marks, but this estate is mainly used as a commercial feasibility exploration, growing a lot of coffee varieties). Another feature of the jadeite special batch is that each batch has a separate number, while all the coffee beans in a batch come from a small plot, so that buyers can choose the batch that suits them according to their subtle flavor preferences. (the buyers here are buyers who deal directly with the Jadeite Manor.) it should be noted that every year, the Jadeite Manor selects a number of jadeite selections from different plots to participate in the international auction of high-quality coffee raw beans. This batch of jadeite selection will be clearly marked as bidding lots. However, not all the jadeite selections will participate in the bidding, and the part of the jadeite that has not participated in the competition will be selected as the non-bidding batch.
The bidding batch of Jadeite will take part in the annual Best Panamanian Bean Competition (BOP) to compete with coffee beans grown in other Panamanian regions. Through the cup test to select the king of a group of kings, and then enter the auction link. After entering the auction, buyers can continue to bid to buy their own coffee beans, the highest auction price will be called by the domestic coffee industry as the "bid king", and if the rose summer coffee beans are the highest price for the whole auction, it will be called "Rose Summer" by the domestic coffee industry. Therefore, "bid King Rose Summer" has become a general name representing the highest price of Rosa varieties in the BOP auction. The greatest significance of trademark registration is that the trademark registrant has the exclusive right to use the trademark, protected by law, others do not dare to counterfeit, otherwise they can sue for infringement and obtain economic compensation. However, recently, there have been a lot of rights protection incidents on the Internet, saying that some merchants have used a certain name as their own registered trademark, and asked the merchants to remove the products from the shelves and ask for financial compensation. Trademark protection itself is used to protect the exclusive rights of trademark registrants, but now it has brought great potential risks to various industries. Each industry has some common names in the industry, but trademark auditors do not know the common names between each industry. Therefore, even if the general name in Article 11 of the Trademark Law of the people's Republic of China cannot be registered as a trademark, there is no way to completely prevent some universal name trademark registration which is not widely known by the public. At present, the company registered "Red Standard Rose Summer" and "Standard King Rose Summer" has passed the trademark examination and approval of advertising sales. And this company. At the same time, it also applied for the trademark of "Rose Summer Coffee" to the Trademark Office, and the Trademark Office rejected the application, otherwise it might lead to more businesses.

"Red Standard Rose Summer" belongs to the general noun of jadeite selected in China, and it is also a special name. If it is the Emerald Manor as the trademark holder, it may be more suitable. A general name means that within a certain range, the name of a commodity or service that is legally or conventionally used turns the "Red Standard Rose Summer" and "Rose Summer Coffee", which has been sold for many years, into a private trademark of a certain company. the intention is not clear for the time being. It seems that this will bring a lot of risk to the cafes that sell red standard Rosa beans in the industry, which deserves the attention of the industry. In the coffee industry, "Golden Manning" is a registered trademark of PWN Raw Bean Company. Although it has been registered as a trademark protected by local law in Japan, no one has done so in China for so many years. Therefore, coffee practitioners all know that "Golden Manning" is a registered trademark of PWN, so no one is thinking about the "Golden Manning" trademark, because it is a universal name.
