Recently, the Market Supervision Bureau of Yuecheng District of Shaoxing City has investigated and dealt with the illegal act of selling and using imported coffee beans without legal sources in an online celebrity coffee shop.
According to the Shaoxing Evening News, when the Market Supervision Bureau of Yuecheng District of Shaoxing City conducted a law enforcement inspection of an online celebrity coffee shop, it found that the "ETHIOPIA Guji G1" coffee beans being used in the coffee shop did not have a Chinese label and could not provide evidence to prove the legal origin of its coffee beans. At the same time, the coffee shop also has illegal acts of selling "Lamarzocoo" coffee machines and "Victoria Arduino" bean grinders without Chinese labels.
According to the provisions of Zhejiang Province on Comprehensive Control of Anti-smuggling and the Food Safety Law of the people's Republic of China, the Yuecheng District Market Regulatory Bureau imposed a fine of 25000 yuan and an administrative penalty for confiscating coffee beans.
The article mentioned that a "ETHIOPIA Guji G1" used in the coffee shop did not have a Chinese label and could not provide evidence to prove the legal origin of its coffee beans. If the product is not imported food, it shows that this coffee bean belongs to three no-products: no factory name, no production address, no production hygiene license code.
If the product is imported food, it should have a Chinese label. Units or individuals engaged in imported goods shall also request or copy certificates of legal origin of imported goods, and establish voucher files and a system of purchasing and sales records. The certificate of legal origin of the imported goods shall not be less than two years.
According to Article 97 of the Food Safety Law of the people's Republic of China, imported prepackaged food and food additives shall have labels in Chinese; if there should be instructions in accordance with the law, there shall also be instructions in Chinese. Labels and instructions shall comply with the provisions of this Law and other relevant laws and administrative regulations of China and the requirements of national standards for food safety, and state the origin of food and the name, address and contact information of domestic agents. Prepackaged food shall not be imported if it does not have a Chinese label or instruction manual, or if the label or manual does not comply with the regulations.
As for merchants' sales, according to Article 9 of the measures for the Supervision and Administration of Food Safety in Circulation, "Food operators are prohibited from operating the following foods (12) imported prepackaged foods without Chinese labels, Chinese instructions or Chinese instructions that do not comply with Article 66 of the Food Safety Law."
According to the Product quality Law of the people's Republic of China, imported products must have Chinese marks for sale in the domestic market, in addition to prepackaged food and food additives. Other non-food products should also have Chinese labels. It is illegal to sell without a Chinese label.
A person in charge of the Yuecheng District Market Regulatory Administration said: "many small coffee shop operators attract consumers with the publicity of 'coffee beans imported from a certain country to grind coffee', but the channels of imported coffee beans are chaotic, and operators have little awareness of asking for certificates and tickets. There are even illegal acts such as false propaganda and trademark infringement." At the same time, it also said that the Municipal Administration of Supervision will continue to crack down on food safety and false propaganda in the coffee industry, so as to safeguard the legitimate rights and interests of consumers.
The problem of unqualified coffee sources is very common in boutique cafes. One is that there is no corresponding logo in the above case. The coffee shop owner may not have a complete product label using the coffee beans provided by his own roaster or acquaintance; another situation is that the coffee beans purchased from the outside are baked by the coffee shop itself and do not have complete food production qualifications.
According to the provisions of China's food laws and regulations, the raw materials of coffee beans used by coffee shops need to have food business license / food production license, and production enterprises need to have production license and product qualification inspection report. The above two problems are common operational risks of cafes. Recently, market regulators are strengthening the supervision and inspection of the food industry.
