According to Tianyancha App, on October 27, the Kunming Intermediate people's Court of Yunnan Province served an appeal for a trust dispute case to Yousheng (Tianjin) Science and Technology Development Co., Ltd., requiring the above companies to bear the corresponding responsibility for the repurchase price of more than 560 million yuan and interest obligations in the judgment of first instance.

According to public data, Yousheng (Tianjin) Science and Technology Development Co., Ltd. was established on November 15, 2018, and is registered in the eastern part of the Airport Business Park at the intersection of Hebei Road and Central Avenue, Tianjin Free Trade Experimental Zone (Airport Economic Zone). The scope of business includes computer software technology, development, transfer, consulting services, computer system integration services, computer and auxiliary equipment sales, etc., the legal representative is Li Fumin. The legal representative of Yousheng Chengyi (Tianjin) Information Technology Co., Ltd. is Li Fumin and Jiang Luwen.

The legal representative of Shenzhou Youche Co., Ltd. is Lu Zhengyao, the founder of Luckin Coffee. The company was founded on June 27, 2022. The address is located in area C, 1st floor and 2nd floor, North Building, West Academy of Agricultural Sciences, Dazhongsi second Food Factory, Haidian District, Beijing. The scope of business includes network taxi booking business; software technology development, technical services and so on.

The repurchase case served an indictment to the court as early as April 27, 2022, according to the indictment. The plaintiff Luckin Coffee (China) Co., Ltd. requested that the defendant Yousheng (Tianjin) Technology Development Co., Ltd. be ordered to pay the plaintiff more than 560 million yuan in repurchase price and interest. And the defendant Shenzhou Youche Co., Ltd. shall bear the litigation costs and preservation fees in this case.

Confirm that the plaintiff has the right to pledge the 40.36 million shares held by the defendant, and the proceeds obtained by the plaintiff after the disposition of the pledged shares have the priority to be repaid within the scope of the pledge guarantee.

The judgment document of first instance was delivered on August 16, 2022. According to the document, the court of first instance ordered the defendant Yousheng (Tianjin) Technology Development Co., Ltd. to pay the repurchase price of more than 560 million yuan and interest to the plaintiff Luckin Coffee (China) Co., Ltd. The plaintiff has the right to have priority within the range of part of the proceeds from the discount, auction or sale of 36.99 million shares pledged by the defendant Yousheng Chengyi (Tianjin) Information Technology Co., Ltd.

Other claims of the plaintiff Luckin Coffee (China) Co., Ltd. were then rejected. The fee for accepting the case is 2929467 yuan, 2.9 million yuan borne by the defendant Yousheng (Tianjin) Technology Development Co., Ltd., and 29467 yuan by the plaintiff Luckin Coffee (China) Co., Ltd.

The contents of the announcement show that the plaintiff Luckin Coffee (China) Co., Ltd. did not accept the original civil judgment to appeal, the appeal request is to change the sentence of the appellee to bear the responsibility of making up the difference between the first and second items of the judgment of Yousheng (Tianjin) Science and Technology Development Co., Ltd. (that is, the repurchase price is more than 560 million yuan and the corresponding interest).

And request the court to decide in accordance with the law that the acceptance fee of the second instance of this case shall be borne by the appellee Shenzhou Youche Co., Ltd., and the property preservation fee shall also be borne by the appellee Shenzhou Youche Co., Ltd. And Yousheng (Tianjin) Technology Development Co., Ltd.
